# Terms of Service

Welcome to Everfleur. These Terms of Service ("Terms") govern your access to and use of our website and your purchase of our products (the "Site" and "Products"). By visiting the Site or purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
## 1. Eligibility
By using the Site, you represent that you are at least 18 years of age, or the age of majority in your state or province of residence, and that you have the legal capacity to enter into a binding agreement.
## 2. Our Products
Everfleur sells washable, absorbent underwear designed for light bladder leaks. Our Products are everyday apparel and general wellness products.
**Important — not medical advice.** Our Products are not medical devices, and nothing on the Site is medical advice, diagnosis, or treatment. Bladder leaks can have many causes, some of which benefit from medical care. If you have concerns about your symptoms, or if your symptoms are new, worsening, or accompanied by pain, please consult a qualified healthcare provider. Using our Products is not a substitute for seeing a doctor.
We make every effort to display our Products accurately, but we cannot guarantee that your screen's display of colors (including our shades) will be exact.
## 3. Orders and Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or errors in pricing or Product information. If we cancel an order after you have been charged, we will issue a full refund.
Prices are listed in U.S. dollars and may change at any time without notice, except that changes will not affect orders already placed. In the event of an obvious pricing error, we reserve the right to cancel the affected order and refund you in full.
By providing a payment method, you represent that you are authorized to use it and you authorize us to charge the total order amount, including any applicable taxes and fees.
## 4. Promotions and Bundles
Promotional offers (such as bundle pricing or free items included with qualifying purchases) are subject to the terms stated at the time of the offer, cannot be combined with other offers unless expressly stated, and may be modified or withdrawn at any time. Free items included in a bundle have no cash value; if a bundle order is partially refunded, the refund is calculated on the basis of the bundle price actually paid.
## 5. The 60-Night Guarantee
Our guarantee is simple: **60 nights. Every pair. If anyone can tell, we pay.** The full terms of the guarantee, including how to make a claim, are set out in our Refund Policy, which forms part of these Terms.
## 6. Shipping and Risk of Loss
Shipping terms are set out in our Shipping Policy, which forms part of these Terms. Risk of loss and title for Products pass to you upon our delivery of the Products to the carrier, except that we will work with you in good faith to resolve lost-in-transit shipments as described in the Shipping Policy.
## 7. Intellectual Property
The Site and all of its content — including text, graphics, logos, images, product names, and design — are the property of Everfleur or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.
## 8. User Conduct
You agree not to use the Site for any unlawful purpose, to interfere with the Site's operation or security, to scrape or harvest data from the Site, or to misrepresent your identity when using the Site.
## 9. Reviews and Submissions
If you submit reviews, comments, photos, or other content to us or through the Site, you grant Everfleur a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display that content in connection with our business, including in marketing. You represent that your submissions are your own, are accurate, and do not violate the rights of any third party. We may remove any submission at our discretion.
## 10. Disclaimer of Warranties
Except for the express guarantee described in Section 5 and our Refund Policy, the Site and Products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
## 11. Limitation of Liability
To the fullest extent permitted by law, Everfleur will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Products. Our total liability for any claim arising out of these Terms or your purchase will not exceed the amount you paid for the Product(s) giving rise to the claim. Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.
Nothing in these Terms limits any rights you may have under applicable consumer protection law that cannot be waived.
## 12. Indemnification
You agree to indemnify and hold harmless Everfleur and its officers, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.
## 13. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which Everfleur is registered, without regard to conflict-of-law principles. You agree to first contact us at contact@everfleur.com to attempt to resolve any dispute informally before pursuing formal action.
## 14. Changes to These Terms
We may update these Terms from time to time. The version posted on the Site at the time of your order governs that order. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
## 15. Severability
If any provision of these Terms is held to be unlawful or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
